So yeah I try to join battles that aren't full (guy on voice comms telling me so) and myself looking at player count from the galaxy map, and it tells me the battle is full please wait or leave.
There may only be 3 in combat and a forth waiting for a transit phase. (assuming a 4 ship limited sector)
